More and more states are adopting what is known as the Medicare Supplement Birthday Rule, and understanding how it works could save you money and give you more flexibility than you ever thought possible.

Why the Birthday Rule Exists — The MA vs. Medicare Supplement Problem

To understand the Birthday Rule, you first need to understand the fundamental difference between Medicare Advantage and Medicare Supplement when it comes to your ability to switch plans.

Medicare Advantage plans are annual plans. Every year during the Annual Enrollment Period (October 15 through December 7), Medicare Advantage policyholders can shop for a new plan, switch carriers, or change coverage all without being subjected to medical underwriting. This gives Medicare Advantage enrollees enormous flexibility.

Medicare Supplement plans work differently. Unlike Medicare Advantage, which is regulated federally, Medicare Supplement policies are regulated at the state level. This means there is no nationwide equivalent to the annual plan change opportunity that Medicare Advantage enrollees enjoy. In most states, if you want to switch your Medicare Supplement plan after your initial enrollment period, you can be subject to medical underwriting, meaning insurance companies can review your health history and potentially deny you coverage or charge you higher premiums based on pre-existing conditions.

This imbalance has led several states to take action.

What Is the Medicare Supplement Birthday Rule?

The Birthday Rule is a state-level regulation that allows Medicare Supplement policyholders to switch to a new plan or carrier each year around their birthday without being subjected to medical underwriting. This means you cannot be denied coverage or charged more because of your health history during this window.

The Birthday Rule essentially gives Medicare Supplement policyholders a version of the same annual shopping opportunity that Medicare Advantage enrollees have: the ability to shop for better rates or different coverage once a year without health questions.

📌 Key Point: The Birthday Rule typically applies to switching to an equal or lesser plan. In most states, you can switch to the same plan with a different carrier, or to a plan with equal or lesser benefits — but not to upgrade to a more comprehensive plan without underwriting.

Which States Currently Have the Birthday Rule?

As of 2026, the following states have adopted the Medicare Supplement Birthday Rule:

Additionally, Minnesota has added an annual enrollment period for Medicare Supplement policyholders, a similar concept that gives Minnesota residents a regular opportunity to switch plans without underwriting.

States With Pending Birthday Rules

The trend is accelerating. As of 2026, four additional states have pending rules that could give their residents similar protections:

📌 New York Note: New York already has some of the strongest Medicare Supplement protections in the country, with year-round guaranteed issue, meaning New York residents can switch Medicare Supplement plans at any time without medical underwriting. This makes New York one of the best states in the nation for Medicare Supplement flexibility.

The Trade-Offs — What the Data Shows

The Birthday Rule sounds like an unambiguous win for policyholders and for the individual consumer; it often is. However, the broader market data tells a more complicated story.

In reviewing data for states that implemented Birthday Rules between 2022 and 2024, two significant trends emerged:

Higher Premium Increases

Average Plan G rate increases in states with Birthday Rules were cumulatively 1.7% to 4.9% higher than a nationwide baseline of states without special rules in the three years following implementation. When insurance companies can no longer use medical underwriting to manage risk, they compensate by increasing premiums across the board.

Fewer Carriers in the Market

In the three years following the Birthday Rule implementation, states with the rule averaged a 38% reduction in the number of carriers offering Medicare Supplement products. For comparison, states without special rules saw only a 29% decrease over the same period. Fewer carriers mean less competition, which can ultimately lead to higher prices and fewer choices for consumers.

When these two factors are considered together, it is possible that states with Birthday Rules could eventually be faced with only a handful of participating carriers offering elevated premium rates, the opposite of what the rule intended to achieve.

What This Means for You

If you live in a state with the Birthday Rule, here is what you should know:

  • You have an annual window around your birthday to shop for a lower premium on your Medicare Supplement plan without health questions
  • Work with an independent broker who can compare every carrier in your state — not just one company
  • Start shopping 60-90 days before your birthday so you have time to review options and make a decision
  • Understand the limitations — most Birthday Rules restrict you to switching to an equal or lesser plan, not upgrading to more comprehensive coverage

If you live in a state without the Birthday Rule, including most of the country, your options for switching Medicare Supplement plans without underwriting are more limited. However, there are still situations where you may qualify for a guaranteed issue right, such as losing other coverage or moving out of a Medicare Advantage plan’s service area.
